Notice of the Ministry of Education on Regulating the Work of Accepting International Students in Our Colleges and Universities

The Education Departments (Education Commissions) of all provinces, autonomous regions and municipalities directly under the Central Government, the Education Bureau of the Xinjiang Production and Construction Corps, the colleges and universities under the ministry, and the colleges and universities jointly established by the ministry and the province:

In accordance with the Education Law of the People's Republic of China, the Higher Education Law of the People's Republic of China and the Nationality Law of the People's Republic of China, in order to maintain the fairness of higher education in China, in accordance with the requirements of the Administrative Measures for the Recruitment and Training of International Students in Schools, the following supplementary provisions are hereby made for colleges and universities to accept applications from international students to study at the junior college stage of our colleges and universities:

1. According to Article 5 of the Nationality Law of the People's Republic of China, if both or one of the parents are Chinese citizens and settle in a foreign country, and they have foreign nationality at birth, they do not have Chinese nationality. From 2021 onwards, those who apply to enter the junior college stage as international students should hold a valid foreign passport or nationality certificate for more than 4 years (inclusive) in addition to meeting other application qualifications of the school, and have a record of actual residence in a foreign country for more than 2 years in the last 4 years (as of April 30 of the year of admission) (actual residence in a foreign country for 9 months in a year can be calculated as one year, subject to entry and exit visas).

2. Residents of the mainland (mainland), Hong Kong, Macao and Taiwan who apply to study as international students at the junior college level of our colleges and universities after immigrating and obtaining foreign nationality shall meet the requirements of the first paragraph of this notice.

3. Colleges and universities shall strictly review the nationality and qualifications of international students applying for admission in accordance with the law.

4. Colleges and universities may formulate their own regulations on the basis of this notice and make further requirements for the status and qualifications of international students to apply for admission.  4. All provincial education administrative departments are requested to forward this notice to all colleges and universities in their respective administrative regions that recruit international students.

5. This notice shall come into force on January 1, 2021. The Notice of the Ministry of Education on Regulating the Work of Accepting Foreign Students in Colleges and Universities (Jiao Wailai [2009] No. 83) issued on November 16, 2009 shall be repealed at the same time.

6. The final interpretation of this notice belongs to the Ministry of Education.
